New Jersey DUI Law

What Happens After a DUI Arrest in New Jersey?

New Jersey's DUI laws are among the strictest in the country. Here's what you're facing — and why acting fast matters.

🚗

License Suspension — First Offense

A first-offense DUI in NJ with a BAC of .08–.09 results in a 3-month suspension. At .10 or above, that jumps to 7–12 months. Refusing a breathalyzer triggers an automatic 7-month suspension — even if you're found not guilty.

💸

Fines, Surcharges & Fees

NJ fines alone can exceed $1,000, but surcharges, insurance rate increases, and MVC fees push the true cost to $5,000–$10,000+ for a first offense. An attorney who reduces or dismisses your charge can save you far more than their fee.

No Plea Bargaining in NJ

New Jersey prohibits DUI plea bargains — you cannot plead down to a lesser offense. This makes having a skilled defense attorney essential. Winning requires attacking the traffic stop, the breathalyzer calibration, or police procedure.

Second & Third Offenses

A second DUI in NJ means a 2-year license suspension, mandatory 30 days of community service, and possible jail time. A third offense carries a 10-year suspension and up to 180 days in jail. Prior offenses are counted for life with no look-back period.

🧪

Alcotest Defenses

NJ uses the Draeger Alcotest 7110 device. Defense attorneys regularly challenge this machine's calibration records, maintenance logs, and operator certifications. A successful challenge can result in a complete dismissal.

📋

Ignition Interlock (IID)

As of 2019, NJ requires an ignition interlock device for most DUI convictions — including first offenses. An attorney may be able to minimize the interlock period as part of your defense strategy.
